Court adjourns Samuel Anyanwu’s case against INEC, others to Feb 24

Hon. Justice I. E. Ekwo has adjourned to February 24, 2025, the case filled by Senator Samuel Anyanwu against the Independent National Electoral Commission, INEC, and the acting Chairman of the People’s Democratic Party, Amb. Iliya Umar Damagun.

Justice Ekwo presiding over the matter on Wednesday at the Federal High Court Sitting in Abuja further instructed Anyanwu as the plaintiff to inform the defendants; INEC, acting Chairman of PDP, of the adjournment so they will be present to respond to the suit filled against them.

This was seen in a certified true copy of the proceedings of the Court, signed on Wednesday by the Judge, Hon. Justice Ekwo, and the Registrar, Chioma Chijioke (Mrs).

The case with suit no FHC/ABJ/CS/254/2025 dated and filed on the 13th day of February, 2025, has “AN ORDER OF INTERIM INJUNCTION restraining the 1st Defendant, INEC its servants,agents, and officers from in whatsoever or howsoever manner accepting, acting on or giving effect to any correspondence, letter, document, mail, notice, form and or written submission purported to emanate from the Peoples Democratic Party (PDP) not signed by the Plaintiff pending the hearing and determination of the Motion on Notice for Interlocutory Injunction filed simultaneously with this Motion Exparte.”

It also involved “restraining the 2nd Defendant; PDP acting Chairman, his servants and or agents from whatsoever manner forwarding, sending or dispatching to the 1st Defendant any correspondent, letter, document, mail, notice, form and or written Submission purported to emanate from the People Democratic Party (PDP) signed by the 2nd Defendant and not counter signed by the Plalntiff pending the hearing of the Motion on Notice for Interlocutory Injunction filed simultaneously with this Motlon Exparte”.

The Court having considered the application, ordered the Plaintiff/Applicant, Anyanwu to put the Defendants/Respondents on notice of the Motion Ex-parte within 2 days of this Order, for them to show cause on the next date; February 24, 2025, why the prayers on the Motion Exparte ought not to be granted.

They; Defendants/Respondents are to be served all processes in the case within 2 days of the Order.
